Daysee Photo and Model Release

Permission Granted

Subject to the scope of permission you select in the booking flow, you grant Daysee a non-exclusive, worldwide, royalty-free right and license to capture, reproduce, edit, crop, adapt, publish, display, distribute, and otherwise use photographs and visual depictions from your session that include you or the minor participant(s) for Daysee’s portfolio, website, social-media channels, studio displays, editorial materials, advertising, and other promotional or marketing materials.

The specific scope selected in the booking flow controls. If you select a limited option, such as permission for Daysee’s website and portfolio but not social media, Daysee will honor that limitation for future uses to the extent reasonably practicable.

No Identification Unless Agreed

Daysee will not intentionally identify a child by full name in public-facing promotional materials without separate, express permission. Daysee may use a first name, initial, age range, or non-identifying description only if you expressly authorize it in the booking flow or another written communication.

Parent or Guardian Authority

For each minor participant, you represent and warrant that you are the parent or legal guardian with authority to grant this Release, or otherwise have legal authority to do so. You agree to notify Daysee immediately if that authority changes or if any person with legal decision-making authority objects to future use.

Editing; No Approval; No Compensation

You understand that Daysee may edit or combine the images with text, graphics, or other content, provided that Daysee will not knowingly use an image in a manner that is defamatory, unlawful, or materially misleading. You waive any right to inspect or approve the finished materials in which the images appear, to the fullest extent permitted by law.

You agree that no compensation, royalty, or other payment is due for the uses authorized by this Release. This Release does not transfer Daysee’s copyright in the images or grant any ownership right to you beyond the personal-use license provided in the applicable Session Agreement and Terms of Service.

Withdrawal of Permission for Future Use

You may withdraw this Release for future promotional use by sending a written request to hello@dayseestudio.com with the subject line Photo Release Withdrawal. Daysee will use commercially reasonable efforts to stop new promotional uses after receiving and verifying the request.

Withdrawal is prospective only. It does not require Daysee to recall, destroy, remove, or alter materials that were printed, published, distributed, scheduled, committed to production, or otherwise in use before Daysee received the request. Daysee may also retain archival and business-record copies as permitted by law.

Release of Claims

To the fullest extent permitted by law, you release and discharge Daysee and its owners, members, employees, contractors, agents, successors, and assigns from claims arising solely from Daysee’s authorized use of the images under this Release, including claims for invasion of privacy, violation of publicity rights, or misappropriation of name or likeness. This release does not apply to Daysee’s use outside the permission granted here, gross negligence, willful misconduct, or any liability that cannot lawfully be released.

General

This Release is governed by New York law. If any provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will remain in effect. This Release is the complete agreement concerning the promotional use of the covered images and may be accepted electronically.
